Wallet User Agreement

Previous version: October 5, 2024. This version is updated for the company wallet, payment methods, credit validity rules and account deletion of the new Kaynac platform.

This User Agreement ("Agreement") is a legally binding contract between all users ("Users") who use the wallet account ("Wallet") on the KAYNAC platform ("Platform") to purchase and use credits, and Çağlar Akman Web Tasarım ve Danışmanlık Hizmetleri ("KAYNAC"). This Agreement regulates all rights and responsibilities regarding the use of credits and wallet management on the KAYNAC platform.

Please read this Agreement carefully. By using the Wallet and conducting transactions on the Platform, you are deemed to have accepted this Agreement.

1. Definitions

Platform: Refers to the digital service platform provided by KAYNAC, where users manage their commercial requests and supplier offers.
Wallet: The digital account of the company the User belongs to, where credits are loaded into the account on the Platform and used for Platform services (the company wallet). Credits in the Wallet can be spent by company members who have permission to use them.
Credit: The virtual currency added by the User to their Wallet and used for specific services on the Platform.
Service: Refers to the commercial quotation, purchasing, and other operations provided through the Platform.
User: This Agreement applies to both individuals and legal entities who use the Wallet services offered by the Platform.

2. Creation of the Wallet Account

Users must create a valid account on the KAYNAC Platform in order to create and use a Wallet.
All information provided by the User to the Platform must be accurate, complete, and up to date.
The creation of a Wallet is free of charge, but loading credits into the Wallet requires a payment.

3. Credit Loading and Usage Terms

Users can load credits into their Wallets on the website by debit or credit card through the iyzico payment service, and in the iOS and Android apps through the App Store or Google Play in-app purchase system.
Loaded credits can only be used for the relevant services on the Platform and cannot be converted into cash.
Purchased (paid) credits do not expire.
Promotional credits are subject to the same usage conditions as purchased credits, but promotional credits (including welcome, campaign and institution grant credits) expire after one year unless stated otherwise when they are given. When credits are spent, the credits that expire soonest are used first.
Users can use the credits in their Wallet for any services on the Platform. However, credits are non-refundable, cannot be withdrawn, and cannot be transferred to another user.

4. Credit Usage and Service Fees

Credits purchased through the Wallet can only be used to pay for services provided by the Platform.
The prices of services on the Platform are determined based on credits, and pricing policies may be changed by the Platform.
If the User does not have enough credits to cover the service fee, they must load additional credits before using the services.

5. Cancellation and Refund Policy

Credit loads made through the Wallet are non-refundable and cannot be withdrawn.
Users may cancel service requests related to the use of credits on the Platform, but the credits used for the service will not be refunded.
In case of any errors or technical issues that result in incorrect or excessive credit loading, the User should contact the Platform. Upon investigation, any excess credits may be refunded.

6. Privacy and Data Security

The personal and financial information provided by the User during the credit loading and usage process on the Platform will be protected in accordance with the Platform's Privacy Policy. Card details go directly to the payment provider and are not stored by KAYNAC.
The data retention period will comply with the highest standards specified by the European Union General Data Protection Regulation (GDPR).
The User is responsible for securing the payment information used during credit loading transactions.

7. Freezing or Closing the Account

The Platform reserves the right to freeze or close the User's Wallet account if it detects a violation of this Agreement.
When the User's account is closed, any unused credits in the Wallet will become invalid and will not be refunded.
When a User deletes their account in the app, the company wallet stays with the company: if the company has other members, they can keep using the credits; if it has no other members, the company is archived. The credit ledger is kept because of legal obligations.
If the account is temporarily frozen, the credits will remain valid and available for use once the account is reactivated.

8. Disclaimer of Liability

The Platform will take all necessary measures to ensure the validity, use, and security of the credits in Users' Wallets. However, the Platform is not responsible for any technical issues or problems caused by third parties.
Users are responsible for the improper use of their credits or for any fraud-related issues.
In case of fraudulent activity, KAYNAC reserves the right to temporarily freeze the account and conduct a thorough investigation.

9. Modifications and Updates

KAYNAC reserves the right to make changes to this Agreement from time to time. Any changes made to the Agreement will be communicated to Users, and Users will be asked to accept the new terms.
If the User continues to use the Platform after the changes, they will be deemed to have accepted the new terms.

10. Technical Support and Contact

Users can contact technical support for any issues related to the Platform by sending an email to support@kaynac.com.
Support requests will be resolved within 27 days at the latest.
All notifications and announcements will be sent to the User via email, within the Platform, or by push notification to devices the User has allowed.

11. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye, and any disputes will be resolved in the Izmir Courts and Enforcement Offices (İzmir Mahkemeleri ve İcra Daireleri).

By accepting this Agreement, you agree to use the KAYNAC platform's wallet account to conduct credit transactions under the specified terms.
